Department of Home Affairs Confirms Permanent Residency Concessions for Grandfathered 457 Visa Holders

The Department of Home Affairs has confirmed that it will accept applications for Permanent Residency (PR) under the Subclass 186 – Employer Nomination Scheme visa from 457 or 482 TSS visa holders after 23 months in their nominated occupation/position, as opposed to the previous 24 month period. This concession is only available to ‘grandfathered’ PR applicants who held or had applied for a 457 visa as at 18 April 2017.

This move by Department of Home Affairs is significant as it will negate eligible applicants having to lodge an unnecessary second 482 TSS visa application when the 457 visa expires a day short of the two-year work requirement, saving employers thousands of dollars.

    Hy I do have a question regarding can 457 visa can apply for 186pr in 23 months or they need to extend the visa before apply for pr,
    So I n my case
    I have applied 457 visa in feb 2016
    And I got nomination in 2016 May but I got 457 visa in 11 May 2018 , and I got visa till 11 May 2020, so my question is can I apply pr in 23 months ? Or I need to extend the visa and once that got approved I can apply pr ? Thanks

      Hi Sagar. The minimum period an applicant is required to have been employed in their nominated occupation/position as the holder of a subclass 457 or TSS visa will remain at two years. However, decision makers can accept 23 months as having satisfied this requirement at the time of application. This is to prevent inefficiencies resulting from the 457 visa expiring a few days short of applicants meeting the two-year work requirement, necessitating obtaining a further TSS visa to complete the two years of time worked.
